Dual Association

Q. Can a real estate salesperson be associated with more than one real estate broker?

A. Yes, a real estate salesperson can be associated with more than one real estate broker, provided separate real estate license applications are filed with the Department of State that include statements from each real estate broker that they are aware of the dual association.  Additionally, New York State Rules and Regulations specifically state that a real estate broker “shall not accept the services of any salesperson or employee in the organization of another real estate broker without the knowledge of the broker” and a real estate broker shall not directly or indirectly offer something of value to influence or reward the actions of a salesperson or employee of another real estate broker without the knowledge of such broker. 

Important Tip:   A real estate salesperson working under an Independent Contractor Agreement should consult the terms of the Agreement for provisions that may limit their ability to seek additional associations.
